Does your company qualify?

To be certified as a Qualified Kansas Business, your company must meet the program’s eligibility requirements. Review each category below.

1. Kansas business and operations

Your company must be a Kansas business with its headquarters in Kansas. It must have a reasonable chance of success and the potential to create measurable Kansas employment.

Under Kansas Department of Commerce program guidelines, a business must have at least 60% of employees o 80% of operations located in Kansas.

What qualifies as a Kansas business?

Kansas law defines a Kansas business broadly, including certain businesses domiciled in Kansas and corporations conducting substantial business or production in the state.

K.S.A. 74-8132(e)

“Kansas business” means any business owned by an individual, any partnership, association or corporation domiciled in Kansas, or any corporation, even if a wholly owned subsidiary of a foreign corporation, that does business primarily in Kansas or does substantially all of such businesses’ production in Kansas.

The statute uses the terms “primarily” y “substantially all.” Kansas Department of Commerce program guidance provides numerical thresholds for applying these standards.

Important: Meeting the statutory definition of a Kansas business does not automatically establish eligibility for the Angel Investor Tax Credit. Qualified Kansas Business certification has additional requirements, including Kansas headquarters and other program criteria.
